I'm not a lawyer, but I played one on the radio (I did, yes! ), but I note one important word in the phrase above: "or". The sticker says in its EPA Fuel Economy Estimates: HIGHWAY MPG 41.
Therefor, the smart should qualify. And I should have moved to CT, I would have saved $923.90! Well, too late. I'm still paying taxes in the only place in the USA that has "taxation without representation"...

Yup, this was confirmed via my purchase order, thats a substantial savings. I was also suprised that the doc fee at Fairfield was only $299, less than I expected for Fairfield County!

Documentation or Conveyance fees are regulated in most states. That's why people in Florida get stung. Every car I've bought since moving to CT in '92 had a charge of $299.
I went to NY to buy my Mini, and paid $41. Their maximum is $45.
I met the guy responsible for the tax exemption in CT. He had initiated the litigation since the new law was assumed to be for hybrids only, but stated that the requirement was based on mileage and not combustion system. He had said to me that there was a single line in the legislation that allowed the smart to qualify (as far as new vehicles for 2008 to 2010 were concerned). So I shook the had of the man who saved me $1000+.

My dealer sent a check for my sales tax.
The only problem is I moved to Massachusetts since I bought the car, so now I have to pay Mass tax on the purchase.
just a quick note on the CT dealer conveyance fee, it appears from my invoice, that it has gone up a bit to $329, plus there is a $3 CT lemon law and a $5 Greenhouse additional fee. (and i will ask the dealer later this week about the $30 increase, certainly not a deal breaker, just curious)

You should not pay any of the CT taxes only MA with a MA address.
You will pay MA sales Tax as well.... Its all worth the pain to have your own smile machine
