Yeah, use it. Mobil 1 also has fuel conserving 0w30 syn oil available now.

If you feel the need to choose an oil from M-B Sheet 229.5, there 81 different formulations from about 40 different brands with M-B approval for the smart. 229.5 is updated periodically, most recently on 04 FEB 10. All the oils are either 0W30, 0W40, 5W30 or 5W40. In the past, the overwhelming number were 5W30s but now there are slightly more 5W40s (5W40 - 30, 5W30 - 23, 0W40 - 15, and 0W30 - 13).

Mitsubishi Motor Corp does not recognize M-B 229.5 at all, and the information that I have gleaned from UK and Continental Mitsu dealers that service the Mitsu i-Car (same basic engine as the smart) is '...any quality, full-synthetic engine oil of the proper viscosity for the climate.'

Under the Moss-Magnusen Act, no manufacturer, distributor or dealer doing business in the U.S. can force an owner to use a specific service fluid brand under threat of warranty denial.

Minor clarification: Section 102(c) of the Act prohibits tying arrangements that condition coverage under a written warranty on the consumer’s use of an article or service identified by brand, trade, or corporate name unless that article or service is provided without charge to the consumer. So an OEM like smart can prohibit you from using any oil other than Mobil 1 0W-40 full synthetic, but in order for that prohibition to be legally valid under the Act, smart would have to provide you the Mobil 1 OW-40 oil for free.
