(not terribly familiar with CA's rules regarding engine swaps, but that does look interesting...)

As far as getting the swap in a Smart and having it legally registered swap you will not be able to do it. Cali states that you have the use an engine newer than the smart. So as long as the engine is current year of your smart or newer and has all smog emmision equipment unaltered and passes smog. Then you can have it legally registered
