Smart Car with less than 800 miles & Rear End Collision with BMW 5 Series

I love my Smart that I got as an orphan about 3 weeks ago, 2 August 2008. In fact, I even waxed it this weekend with NuFinish after washing it. On my way home, I was waiting to make a right hand turn, and a BMW 5 Series hit me from behind while I was not moving. I'm stiff and sore and grateful that is all.
My wonderful Smart for Two Cabriolet that is yellow with yellow running boards has a dent in the bumpter and an area where the bumper looks like it actually got scratched down below the paint. I'll take it to the dealer tomorrow to have them make sure it is safe to drive, that the transmission is all right, and the engine. All that good stuff is in the back!
I feel sad it's not perfect and wonder, other than the usual taking care of myself and car insurance efforts, there is anything I need to do. So it's off to the dealer for me.

Barb, Glad you're OK and it sounds like the smart faired pretty well also. Keep us posted on the repairs, etc.

a bumpter shouldn't be too hard to replace...

I would contact a personal injury attorney asap. Have yourself checked out by a doctor. I have friends that have been in car accidents that have had lingering pain long after the initial accident. They always told me to get yourself checked out if you are ever tweeked in an accident. It may help to avoid pain and suffering down the road. Personally I would sue the innattentavie driver of the BMW and their insurance company for every penny possible. I see daily, so many people on cell phones crossing over lane divider lines, it's disgusting. They are as bad or worse than drunk drivers.

Barb,

Take care of yourself first. If you are hurting, go see the doctor!

As far as calling an ACDBL (Ambulance Chasing Dirt Bag Lawyer), I would give the guy and his insurance company a chance to do the right thing before I would even think about a law suit. But get a small notebook and take notes of every conversation with the insurance company and who said what when and where they were when they said it.

ABSOLUTELY!!! go get checked out! i'm sure your little yellow Cabriolet can survive and be driven again. YOU on the other hand may have some 'hidden damage' as well. GO TO THE DOC!
