The e-bay seller states..."I will have it TITLED in your name so you will be the first one to own it". From everything I have read, Smart will not sell to brokers, this clown is clearly trying to be a broker. I had to give my license number when I did the $99 so they will know who they buyer is namely me. How can this seller say he can title it in someone elses name? This is the kind of activity Penske is trying to fight. I hope they can find out who he is and cancel his order. In addition anyone who sells a Smart immediately for profit will owe the IRS on the gain, and it will be figured at your ordinary income tax rate, not at the lower capital gains rate.

This guy has probably been planning on doing this from the beginning...To be lawful, I would suggest that he takes delivery, registers the car,then attempts to sell it a week later.
No one would care that they are second owner...I sure wouldn't.
That way, he can ask whatever he likes. It is, after all, HIS car.

Who really cares if someone wants to spend their money buying a Smart car well over MSRP

I said first week on the web site that I was buying my Smart car for me...

However, I admitted that if anyone offers more then $3,000 above what I paid ----they are gonna be a winner because it is just a damned car.

If that happens, are all the acquaintances I met here all of a sudden gonna slam me for being some sort of bastard?

Can you tell I hate censorship and any restriction on our freedoms?

I support the freedom to say this guy is profiteer and express our angst that he consumed one or more valuable reservation slots... but seriously the only folks who have a dog in that hunt are the ones without a reservation...As long as there is no closing of the reservation pool, then even they, don't have much of an argument...

However "Lets can this guy" is a bit much

OH by the way--- I think the E-bay ad for a 08 Smart car at a significant markup should be ignored......just like I ignore all the other hyped up overpriced stuff...

I get all sort of stuff off e-bay...but I do not bid at auction and I always know what the item should cost and how much I am willing to pay... E-bay can be an excellent resource for items that are just not for sale anywhere locally...

I agree with Fred to a degree but we are in a free enterprise society, after all. The only violation that I can see now is that, 1) The reservation rules did state that dealers or brokers are forbidden to apply for the $99 reservation and become a holder of a reservation. I would think that he surely is acting in this capacity as a broker if he is talking about title transferring before he actually owns it himself. (not even sure how that can be done really) He doesn't have possession of the car yet nor does he even own it so how can he legally sell it on Ebay then....must violate an Ebay statute.
That kind of scalping is just not right but it IS the American way, unfortunately.
But I believe in Carma.....;) Not sure why so many people insist on trying to make a living without working for it. But then PT Barnum's very popular phrase is always reiterated....There's a sucker born every minute.
