4000 miles already leaks oil

Today I decide to wash the engine from the bottom of the car and I saw oil leaking from the oil pan, and the engine -transmission unit, I guees mus be the rear of the engine seal ,
I wash evrithing off and I will go to the dealer for a re-torque of the oil pan.
Any one with this problems?
When itwas with few miles I saw oil on the driveway few drops here and there because is dificult to park the car on the same exactly spot I assure tht it was left over oil from the factory.

if mine leaks oil before the first oil change, or for that matter before 100k miles i'll drive it through the dealership's front door.

by order of Smart they are going to change the hole engine or unit as they call it have to wait 8-10 day for the bew unit to arrive in USA.
