Update

Took the Cabrio to the San Antonio Smart Center yesterday.
They took pictures of the top, then called Smart Hdqtrs, Smart said replace the top.
Ten - fourteen days to get the top in.
No problem in making it right.
By the way they replaced the battery under a recall while I was there.
My car is an 09.
I never got a notice about the recall, you folks with 09's might want to check to see if your car is affected.
Later
Rich

Wornhole. One too many humps in wormhole and certainly not womhole. Travel is also only one way in a worn hole: you can't un-wear it.

Thanks for the chuckle.

This looks like a design defect to me. The stress is concentrated at the point where you see it torn. I had a similar problem with a Mercedes roadster I bought in 2000. I'd drive it to work with the top down, put the top up after parking it and then put the top down to drive home. A sharp crease in the clear window turned into a hole. It was covered under warranty with no problem. Thereafter I'd put a car cover on instead of putting the top up every time I parked it.

I'd also avoid putting the top up or down in really cold weather. The plastic gets stiff and brittle and is more likely to tear.

I didn't buy the smart cabrio because we still have the Mercedes. Some times I wish I had bought the cabrio because I drive the smart more.

FYI - The rear window in the cab is glass, not plastic. And the top is fabric, not vinyl. - sheureka
