If you go to the Club Smart Car site in Canada, they have quite a few posts about a dealer that is installing remote starts on the 2008 smart cars, so obviously, it can be done...it's probably not any different than when you first start the car in the Park setting. If you really want it and need it, I'm pretty sure you can 'get 'r done'.. Now, as far as warranty stuff, I think that will be decided if you have any issues that the dealers suspects were caused by the addition of that device but I agree that you may have far more 'legal rights' than dealerships are wanting us to believe when they 'threaten' with the voiding warranty comments, but then I'm not an attorney, so I may not know what I'm talking about.
Having the Park position gives you the ability to use that as a safety to insure you are not in gear. Without a shop manual it is hard to tell without dissecting the car and I don't want to do mine at the moment. Never met a Puritan, way too many lawyers, amazing how they both have so much influence on or lives in the land of the free.

This great little car seems to have its parents sleeping on the job. I guess that would be Penzke. Between the horrible rating from consumer report,little to no advertising, justifiable transmission sluggishness, and some other occasional issues moon roof grazing on some has helped its reputation be far from the stellar it should be. My dealership Benzel Busch in Englewood Cliffs NJ. is as close to perfect as any dealership can get. A Maybach,Mercedes,Audi,and Smart dealer they have given me the same courtesy, respect and incredible service with my Smart as if it were a Maybach (I rate their service 10+) so its not on them that I'm concerned about, but with my investment in the Smart car that Penzke has to get behind. Why not address those comments from Consumer Reports, fix the negatives, have more places that can fix these if you travel outside your home area, and give this car a chance to make it here.

I know that the "viper" alarm system with remote start works on the 451 smart.
One of the DC smart drivers has one and has not had any negative issues.
I put a remote start on my 09 Pure when it was only 1 month old. This was the first one I put on a smart and I am very happy with it. The dealer service manager never said anything to me about it, when I had my 10 and 20000 mile service done. I just told him how to start it and that was it. I purchased it locally and installed it myself. I have done about 8 different makes of car with good results. Mine is made by Bulldog Security.
yes, you do have to sacrifice a key. I used the guts from my key to make it work. I had to start the car with the remote start every time. Then I decided to do the button mod on the switch panel and I wired one button to activate the bypass module that has the guts to the key. Now to start the car, I insert the sacrificed key in the ignition and when I start it, I push the unmarked button on the dash as I turn the key and it starts.
