Uneven upper tailgate

Hey guys,

I just got my red passion a couple of days ago, and I just noticed that on one side the upper tailgate matches evenly with the roof, but the other side doesn't (the upper tailgate sits a little below the roof edge) has anyone seen this before?

That definitely looks crooked** like it was damaged on the driver's side and pushed down...

Probably the hinges have slipped...

Or somebody jumped up onto your roof and sat on it, driving it down like that.
Should not be a very difficult adjustment to correct it....

Yeah, I just hope no one is doing that in the parking lot while I'm at work...*sigh*

I didn't even noticed it until yesterday when someone pointed it out.

I guess I'll just have to take it to the dealer for service this weekend.

Anyways, thanks guys

Funny, I JUST picked up my red smart today, this was one of the first things I noticed. So, I went around the lot and checked them all, 85% had the same issue. Must be a design or manufacture flaw were the mount hole on the left side sits. I THINK it can be moved, it really is just ONE screw on the left side. But, indeed, many that I have seen have this issue.

The gate on my cabrio was uneven when delivered. Service was able to adjust it perfectly after I brought it back.

I'm sure they can do the same for yours.

I noticed the same thing on mine. Same side, too. I lifted the upper tailgate and loosened three screws fastening the panel ( two underneath and one on the side). I wiggled the panel up until it sort of lined up. Good enough until I take it in for the 10K. Sorry, no before and after pics.
