The 2009's literature says the passenger side seat back "adjusts".

If you look at it, the seat travel is limited to come as near to that bar as possible while never actually touching it. Just a single ratchet more recline and the seat would touch the bar. More than that, and it could break it depending on how quickly or forceably the seat is reclined.

Good point! I hadn't thought of that! I plan on getting the cover.

I don't know about anyone else, but my only intent with this "mod" was the ability to recline the passenger seat to the same degree as the driver seat ALREADY can do - from the factory.

Only a superficial limiting tab is bent. The seat ratchet still works and safely locks as it would normally.

Sorry can't, I already "BROKE" my car.. ha ha ha.. j/k well no I can't tape it since I already did the mod, and to about 7 other cars too when we had a little get together, it was quick so we didn't think about taping it. But yea..

Yours reclined backwards on your driver seat? Mines didn't.. I had to bend the tab on both the driver and passenger seat.. as well as all the other smart car i've seen, I wonder if the dealership did it to your driver seat prior?

The driver seats don't recline flat, but they do recline to a point. The passenger seats apparently don't recline, unless you override the limit tab.

It appears the limit tabs are different for driver & passenger, and either one can be overridden..

Hmm... interesting my driver side never reclined at all, it only was able to reclined forward but not backwards to rest my eyes or anything if I was pulled off to the side. Oh well it does now

Wow, that is strange. Now I'll have to go to the dealer and see if the others are like that. Maybe they did override mine before purchase.
