Yes that would be around 16 seconds flat for 0-60 MPH and it is slow, though faster than mine!

How hard would it be to install one of these into a US smart, disregarding the legal concerns?

Everyone needs to write their elected officials and Mercedes,.. repeatedly, and keep asking for a way to get sub liter diesels here. They might not be as clean as some would like, but they are the cleanest engine there is per mile due to the microscopic volume of air they cycle through per mile driven. Lawnmowers run dirtier than this.

As mentioned many times in the past, those engines are for the 450 (not made any more) or the 451 (soon to be not made any more.) Someone could always buy a used diesel engine and try swapping it into a gasser but the overall cost would be prohibitive I'd think.

LOL the problem is that policy is often made not by scientists or engineers, but by politicians and bore-a-crats -- don't hold your breath on this one. I've thought for a LONG time that they need to look not at % but at total pollution produced. Really small fuel-efficient cars would have a big advantage since the TOTAL they produce should be less even if the percentages are slightly higher.

Not easy, but it has been done with a 450 (Leroy)

It ain't cheap, but as pointed out it has been done. If you got all or most of it salvage, it might not be too bad as far as cost, but it would take you a bunch of time.

I would buy the diesel without hesitation over the gas.

It has been mentioned a few times before but I would suspect it would be easier and cheaper for someone who really wanted a CDI to just buy one from a Canadian, have them drive it across, import and register it in a state that has a grey enough law to allow them and then proceed from their. How about registering them as salvage or something. Gotta be a way as i know some have done it.

the key is living in a lenient state. Some are really sticklers, whereas other are not. Of course, it's not legal, but morally justifiable IMO.
