Questions:
Do they add dealer add-ons to the cars that are ordered under the $99 order program so that they can jack up the agreed upon price prior to delivery? That's against the law in most places.

No. With the $99 deposit, you and smart agree on a car. It is not a contract, just an agreement (check the latest exact wording with a recent reservationist). When the car comes in, it is as
configured. The latter may differ slightly (color, price, option) at the time of configuration, but you have the option of declining.

Are the dealers creating orphan vehicles by trying to shake people down for more than the agreed price when the people who placed the order come to pick up their new car?

No. Once your car has been
configured, that is the car that will be available at delivery (except in a very rare case of unforeseeable event such as "lost at sea". Hasn't happen yet, to the best of my knowledge.). Again,
if smart (not the Dealer) cannot deliver that exact vehicle at configuration time (color, price, option) you will be given an opportunity to decline and get your $99 refunded.

Are the dealers telling people who go in to pick up their cars, "Sorry, we had to place the add-ons on the vehicle, take it or leave it." Is this creating instant orphan vehicles when people walk away because they don't want to get ripped off?

Again: no. Once you have configured your car, it will come as specified. The dealer may, and most likely will,
suggest add-ons.
At least that is my understanding. If someone has had a different experience, let us all know. Thanks.
