Well I got the car back Monday. Here is what the invoice says

Customer states: Soft top no longer moves in any direction please advice on any possible repairs.
Internal failure of vehicles soft top roof system performed short test: Passed. No current or stored fault codes. Performed convertible top test schedule with the SDS DAS machine: Failed. Soft top does not move. Removed the neg. side battery cable let car sit for one hours time. Removed the rear spoiler, removed the electrical drive motor top case, pulled soft top back manually, removed both side rails, removed both sliding plates, removed soft top drive cables and realigned, reattached the sliding plates and performed basic operation/alignment test of the rails and sliding plates: Passed. Reattached all parts and retested the convertible top test schedule with the SDS DAS: Passed. Performed road test: Passed. No wind noise can be hard. Mile in 10,030, mile out 10,040. Performed water leak test: Failed. Water leaks near folding rear soft top. Loosed the rear soft-top frame assembly and performed convertible frame alignment assist/location and retested: Passed currently the car is OK.

They also reset my service indicator for no charge and also followed up on my transmission issue I had a few months ago, and there are no issues since, and of course washed and vacuumed out the car.

I have to laugh at this. How can a short test pass when the thing doesn't move? Must be a poorly designed short test. Too short?

I'm glad they have it fixed and took care of the leak before they handed the car back. Good points for them.

It locked it self out of 1st gear, and they reset the system and its been fine since, basically the car thought it was stopped but it was still moving when I went from R to D and the gears hit each other so the computer thought something was wrong.

Also, according to a manager at my dealer, I am the first customer car that they have worked on the soft top.

Yeah it sounded like the cable that operates the top came off the "Cassette"

That is just bad luck: my cabriolet is close to five years old and it's been flawless. I hope yours stays that way too now!

So here we are today, I was out working in the garage, so the smart was in the driveway with the top down, looked like it was going to rain so I ran out and rolled up the top and windows... Few hours later time to go into work, the day is now very nice and as I am leaving my driveway and rolling the top back... CLICK CLICK CLICK and the top... stops about where it did last time, So I close her up, turn on the A/C and call Service again, and the smart gets to go back again early next week.
