There's also the selling of intangible items. You can't sell an idea or place in line. A physical ticket to a concert is legal. Smart doesn't give out physical tickets. They get your DL # and verify ID on delivery.

There's no way a sale like this can go through properly. The two would have to go to the dealership, explain the deal and if the dealer allowed the swap despite Smart's contract, the buyer would be miffed to realize they just paid $2k to get an orphan they could have just by walking in at the right time.

I've heard a tale told by more than one person about someone selling an air guitar on eBay. I never saw the ad myself. Urban Legend, perhaps.

I just Googled it. If the air guitar is legend, it is a widespread legend.

Weirdest thing I personally witnessed was a bent paper clip. It sold. But, that was tangible.
