Talk with the general manager of the dealership. There are lots of Smart Cars sitting on new car lots out there. Have him locate one for you, if you still want it. Did they try to get a hold of you, on the phone? Send you anything in the mail. Did you change your email address? You can always get your $99.00 back from Smart, if they won't find you a car. After those heads meet the sludge hammer and the steam roller. If that was my car I'd tell them to get MY CAR from the people who bought it and offer them an Orphan. That car was designed for you, YOU waited 10+ months not the people like me who would just walk in and buy one.

To me, replacing is not enough, I'd want compensation for them selling off MY RESERVATION!!!

But since I am going for Orphan, I'm not too picky about the colors and the only option I could temporarily go without is the tach and clock.

Yeah, but it's not the new Brabus owner's fault, it's the dealer's fault. I would rather wait and make the dealer do backflips and get a NEW Brabus than take someone else's new car because of a dealer mix-up which is no fault of theirs.

Also, you have to consider that the new owners may be careless, or not breaking it in properly, or smokers or who knows what. I think it's awful what the dealer did but personally I'd wait for a new Brabus....like maybe a couple days tops. Make 'em scramble.

Well, they did lose your car, might aswell have fun watching them pay for their mistake!

Get your 99 bucks back and go get the new Cube. More features for the money and rivals the smart looks.

You're a better person than I am. I'm pretty open about not being thrilled with the service I received from the dealership I wanted to buy from (Virginia Beach, VA) and the dealership I ended up buying from (Alexandria, VA). I think both saw me as being young and stupid (22 year old female purchasing her first car).

I hope you don't have to wait too long to get into your new car. Sucks that this happened, but thanks for letting everyone know.

On a side note, I can't believe how many people are NOT reading the simple facts in this thread. Reservation was made on a BRABUS. Last I checked those are not lined up on the lots in 'orphan' status. There would be no use in going through the inventory to see if something matches his build. If it isn't a Brabus it doesn't match.
