I have been reading this with interest, as I am from Britain and we don't have a waiting list, we see, we sign, we pick up the next week.
I have a couple of questions about words I have never heard of before.
What is an Orphan?
What is lo-jack?
It is strange, I have bought and sold cars for over 20 years, but these terms are not used in Britain at all.

Orphans are abandoned vehicles-we reserve $99, then choose whether or not to take delivery a year later
Thanks for replying so fast guys, lo-jack is what we call tracker, and the police also have tracker device to find stolen cars, it reduces your car insurance if fitted.
Orphans is a funny name for the unwanted cars, but makes sense really, two word you won't hear in a sentence very often, american and sense, as Orphan Begger has just proved by saying, "we fought a war so we don't have to answer to you Brits", and then answered to us Brits, thanks for the laugh Orphan Begger, no offence taken and none meant.

it would be if he were here in Indiana. if you will read his post again, "sillyrabbi" hadn't taken delivery yet. according to his post, the dealer STILL HAD THE CAR....he never took it home. i agree, "IF" he had taken delivery and driven the car home, he would be SOL but such was not the case. at least when this thread was started.......
here in Indiana, one can 'back out' of a contract within 3 days of the date it was signed. if "sillyrabbi" lived here in Indiana AND had taken the car home, he could still 'back out' but as you said, the dealer would more than likely charge him for any mileage, wear and tear, etc, during that 3 day period. if he didn't pay, off to court they would go. BUT since he NEVER TOOK THE CAR OFF THEIR LOT, i see no reason why they wouldn't take it back just to keep in his good graces when HIS smart comes in.
I could read his post again, but he doesn't even state where he is located so not having that information, what can I assume? Very lucky if you live in a state that would allow you to do that, but where I live, once you sign a contract, that contract is binding and there is no backing out of it. Why would a dealership back out a legally binding contract? I guess they could always try to sell it to someone else, and probably that would not be an issue, but I don't think the market is as hot as it was a few months ago, so they might not want to. If you can get out, and that's what you want to do, I hope you can pull it off, but otherwise, you might have a lot of trouble finding someone to take it off your hands without a loss. I think that by now most of the people willing to pay the big bucks on people flipping smarts will be drying up.
Do you have a reservation too? Didn't see whether you had a reservation too. Are they going to want to keep you as a customer for that one too? might make a difference/
