Do i have a lemon?

Do I have a LEMON?
I will make it as short as possible. My Smart Car history is as follows:
DATE DESCRIPTION MILAGE
January 26th 2008 Purchased Orphan 11
March 11th 2008 Engine light on 1300
March 28th 2008 Engine light on 5945
October 7th 2008 Dashes on Dashboard (shifter Replace) 12647
October 31st 2008 Engine light on 13990
November 12th 2008 Engine light on 14568
November 29th 2008 Engine light on 15840
December 6th 2008 Engine light on 16150
Can anyone give me some input on what I can do about this? I asked my Dealer if a set of YELLOW body panels can be put aside for me, because I am driving a LEMON.

I actually had a similar thought. I went to start my car on Monday to drive to work, and it was dead. I couldn't even get it to unlock. I didn't leave a door open, or my lights on... or anything. She just died! They're working on her now... but possible thoughts have been the alternator, or something involving the overzealous installation of LoJack. She's just 6 months old (on Friday). She's too young for this crap!

From what I have read, the shifter may be one of the USA's first common problems, apart from that it's all lights. Did they say what caused it or how they repaired it?

I would hazard a guess at fuel cap switch and maybe the dodgy exhaust air valve that seems fairly popular at the moment.

Sounds like you need to spend the money on a device that will read the codes and reset that engine light.

I have a scan guage 2 , the code that it reads is P0456 . The scan guage can not reset the light, i tried many times.

No i was not, i am driving the dealer demo , a red cabrio. My smart is silver at this time.

I saw a black/black like your profile picture. I figured it was worth a shot. My family lives out that way. Keep an eye out for a red/black passion. Good luck with everything. I'm not real helpful when it comes to mechancial stuff... but if I see you, I'll honk and wave!

As Evilution alluded to, a JAN '08 smart is in the time frame when there were a lot of secondary air valve problems causing a CEL. The valve has apparently been redesigned or at least fixed around JUL '08, and is an easy fix at the dealer. For the $37 part and very little labor involved, I would have it changed whether you/they know it is bad or not.

What was the problem each time when the light came on?

When you have the same problem multiple times, you're getting warm (meaning "Lemon Law") and the dealer will will be a bit more helpful after you muscle them a little. I know here in FL, it used to be 3 times for the same problem way back when. Not sure what it is anymore.
