You basically agreed to smart USA's terms when you reserved that there was no guarantee of a delivery and that you'd accept thier distribution logic. Its purely based on markets and interest. Compared to New York and California the demand in South Dakota is probably pretty low and the potential to sell a lot of smarts is probably equally low. Remember, smart USA is a business and not here to fulfill your desire to buy something at thier loss. They have to be able to market and make a profit in order to stay viable. You only need to look at the dealer map to confirm that there isn't high demand in your area -no dealers from MN to WA in the northern part of the country. So you are probably lumped into the pool with the MN dealer or they are accumulating interest for the opening of another dealer closer to you. The only way you have an argument is that if people with later reservations assigned to the SAME dealer are ahead of you in line.
I'll repeat an earlier comment... think of how silly it is to be complaining about not being able to buy a thing. Its not like this is a necessity for life, it is a material possession. If you MUST have a small efficient car there are other options out there with mass distribution available. I'm sorry you can't have what you want but filing complaints and threatening legal actions isn't going to get you what you want.
