Yes you can, as long as when you got the orphan you did not agree to cxl your reservation, or allow them to treat your confirmed car as an orphan. This means you should not have had YOUR $99 deducted from the orphan purchase
I bought an orphan and the dealer did add on about 3k worth of options. I had no say in that - it was take it or leave it.
I also kept my reservation. The dealer had no mechanism for refunding the $99. My option was to cancel with SmartUSA or keep it. So, I'm thinking I'll go ahead and order when my number comes up (Maybe by end of summer?) and probably sell or trade my orphan Smart. I'm a later reserver (Sep 07), so I'm happy to have this orphan and decide what to do about the reservation later.
I agree that Orphans are handled poorly. There should be consistency across the dealers and there is none.

Seems like all agree we can keep the order alive. (My order is actually allocated to the other dealer in the area)
My orphan had LoJack on it and they were getting ready to load more on when I made a deal for it as is. That's $700 I didn't really need to spend ( at least I hope not), but not a total waste like some other add-ons. I plan to do the same as you, keep the reservation and see how I feel about my orphan and also watch the demand in the used market and follow through based on what makes sense then. I reserved same time as you.
Yeah, one of my options was LoJack with early warning. It has a fob that stays on the keychain. If the car moves 300 ft without the fob, it will email, text and call me. Tho it was spendy, the thought of my little Smartie texting me with "Help, Somebody's got me, come and find me!!" is just irresistible.
The dealer I am assigned has a list of around 100 for orphans. It seems to be growing quite fast now, though !!!!At LEAST 2 ( they won't say exactly ) have gone out already.
I just put down a $1K deposit for an orphan since my reservation won't come up till the end of the year. Its non-refundable and they have not yet explained whether anyone can get on the orphan list or if you have to have a reservation to get on the list. Once I learn the info, I'll share it here. Its the Salt Lake, Utah dealership that just opened last week.
Well....I have to give Cherry Hill a gold star. Finally I spoke to them yesterday, and was told all reservation holders, automatically, are placed on the orphan list. THAT is the way things should be done, IMO.
I was also told, as someone who reserved in early November, 1404, I should expect my car in 3-4 months. To me, this is a bit optimistic, but, I'll TAKE IT! It seems, at the time I reserved, there were under 300 cars assigned to Cherry Hill. Today, that figure has climbed to 1200. People around here, finally, seem to be waking up!
I get to pick up my Blue/Black Cabrio orphan Monday morning from Round Rock Texas Dealer. I do not have to pay for any add ons and can take the car as it was sent out (with comfort pack) I was number 12 on orphan list but several ahead of me had specific demands and I said I would take anything. I still have reservation and config. for a Yellow/black Passion that is expected in May or June #1288 and I will also wait to see if I take it or let it go for orphan. My wife has fallen big time for the car so we might just sell her big Dodge Grand Carivan and become a two car smartcar family

I guess you beat me to it. I am number 15 on the list in Round Rock. It almost made it to me. Jordan said I moved up a couple of notches this week, so I guess I am at 13 now. Maybe I will get lucky soon. With talking to Jordan on the phone, they seem like a real honest outfit in Round Rock. I wish all the dealers were like this. Congrats on the new Smart.
