Form what I have read, there is NO WAY (if you put down your $99 today) you would get a Smart in 08, isn't that false advertising?

They're just saying "Would you like to...". They're not saying you can have one.
ASmartMan, I've been saying that for a month now! I have e-mailed that same comment to the Smart people and have not received a satisfying response. I do agree that it is false advertising!
That statement "Would you like to reserve your very own new 2008 smart fortwo? Our exciting $99 Reservation Program is now open to all smart enthusiasts" implies, if you put $99 down you will "Get" a Smart in 08.
A new comer, who just got enthused would think/believe (I would) would get a Smart in 08, anyone who placed a reservation prior to the update has a legal recourse if they don't get a Smart in 08.
Some reports say PAG has 40K others say 45K reservations as of today, PAG it self has sent E-Mails to the new comers saying 09 delivery.
I just think the SmartUSA web site is VERY misleading (NOW) to the newly enthused.
But to be honest guys... who are we to say that they wont pump out 50,000 if there are 50,000 buyers... I would leave that up to them to prove! They might be pulling an Apple on us ;) do you smell iphone hype?
Anyone who places a reservation with the belief that they will get a car in 08 BUT doesn't, has an actionable claim against PAG.
Anyone who puts a $99 reservation down and is accepted because of the wording of the SmartUSAs website, implies you will get a Smart in 08.
It has been many years since I've chaired a consumer "Class" cause and would have no interest in doing it again, but if PAG doesn't live up to the claims of their web site, I would be willing to consult and pass on past experiences with this kind of case to some of the younger bullets.
Considering you aren't out a penny (the $99 is fully refundable) it would be rather hard to prove any harm done. But hey, you have to love people that want to run to a lawyer everytime they disagree with something. Guess it's just so much fun to find something to get ticked off about.
The website implies if you put down $99 you get a Smart in 08, if you are driving a car that get 20 MPG mixed, and looking to upgrade (MPG wise) to a Smart and don't get it by 12/31/08, you would be entitled to the fuel delta cost from 1/1/09 until you got your Smart.
Remember, they took your money in 07 with the promise of a car in 08, At an absolute minimum, an ambulance chaser would get the "Class" an interest payment from 12/31/08 till the car was delivered.

Hasn't anyone ever worked on a long, complicated project? It is common and normal for a project to get delayed when issues/problems which were impossible to foresee arise along the way. It is common for little issues (like a sentence on a web page) to get overlooked while big issues are being worked on. Many of us smarties seem to have a lack of understanding about the realities of working a large project. Cut them some slack. We have a right to expect Smart USA to be a quality organization, not a perfect organization.
