Weston smart Center

Dropped in to take a look around. Most cars awaiting delivery had errors on the Moroney sticker. Charged for silver tridion even though cars had black ones. Wonder if the dealer subtracted out the $175.00?

Also there were no supplemental stickers showing the dealer prep fee of $499.00 so they are either not charging it or do not know that Florida law requires it.

Spoke to a new owner who's husband was written up in today's news. Both he and she took delivery of new cabrios. Between them they also own a Bentley Continental, Lamborghini, Porsche, and a Range Rover. She tells me she enjoys the smart over all the other cars.

there is no supplemental sticker that discloses the doc fee. i can guarantee you that they are charging it and that they disclose it once you go into the finance office to pay. it appears that the state of FL has the most outrageous fees of all of the states.

the law states that they must disclose the "total price" in any advertising and since a window sticker is not considered advertising, they are covered. the window sticker also does not show taxes and reg fees.

Unless you sold cars in Florida and now live in SD, take it from me, if the Dealer Prep fee is not posted on the car as a supplementary sticker they are breaking the law.

actually, i don't sell cars, but i'm pretty good at doing research. apparently this is a hot topic in the state of FL. i've provided the link below for you to read more in depth, but i'll quote the important clause that i found:

"Based on a reading of both provisions, it appears the dealer has the option to disclose the pre-delivery service fee in the cash price, but is required to do so in any contract for sale of the motor vehicle."

The next issue the opinion addressed concerned
whether prices posted on vehicles either through a
window sticker or painted on the windshield of the car,
are advertisements for the purpose of Rule 2-
19.005(16), F.A.C. The AG concluded price postings,
in any form, must comply with the requirements of the
rule. Therefore, window stickers or prices painted on
windows must include pre-delivery service charges.
Importantly, in answering this question, the AG noted:
[A]ny form of posted price on a motor
vehicle, when done in a manner to sell or
induce the customer to enter into an
obligation relating to the vehicle, is an
â€advertisement.’ (Emphasis added).

The third question the AG addressed asked whether a
motor vehicle dealer could disclose pre-delivery
charges by advertising the price as “plus taxes, tags,
registration and title fees, plus pre-delivery charges.”
After noting state and local taxes, tags, registration and
title fees are exempt from disclosure while pre-delivery
service charges are not, the AG concluded prices could
not be advertised in the manner suggested by the
question.
The last question posed asked whether the fee charged
by motor vehicle dealers to customers for processing
paperwork for tags and title could also be excluded
from the advertised price of a vehicle. In answering this
question in the negative, the AG noted:
The rule appears to contemplate that
excluded from the advertised price are those
fees levied or assessed by a governmental
entity rather than those charges bythe dealer
of processing the paper work necessary to
procure the tag and title, regardless of the
name given such a charge by the dealer.

The AG concluded any fee or charge imposed by the
dealer for handling paperwork, regardless of the name
given the fee by the dealer, must be included in the
advertised price – and the advertised price includes
“any form of posted price on a motor vehicle, when
done in a manner to sell or induce the customer toenter
into an obligation relating to the vehicle.”
In 2003, the Economic Crimes Division of the Office
of the Attorney General readdressed this issue through
an investigation of motor vehicle dealer advertising
irregularities and violations of the advertising

As I read it. The only time the dealer fee is required on the Moroney sticker is if the sticker has a total price. If the items are listed separately without a total the dealer fee need no be included.

Dealer Rip Off

Well I sent my message to corporate about the dealer rip off. Seems my dealer will be doing the same thing and has not got back with me other than it will be at least another $599 to pick up the car when I order it. I was told however that it is a good thing I am not in Orlando where they will be charging their customers $799!!! I thought I better join so I can post my thoughts about being screwed!

I have yet to see a factory sticker that does not show a total price for the vehicle.;)
