They're certainly able to get hold of me about my orphan, and the details in my reservation are correct. I'm working through a variety of channels, but yesterday HQ did confirm what I suspected, that "my" car has already been sold by the dealership.
evidently they must have assumed that you were set since you already had the orphan, that it was okay to sell your original car. (I know...you probably DID tell them that you still wanted your orginal car despite having the orphan) This sucks!

Q: when she purchased her 'orphan', did the dealership apply her $99 TO THAT PURCHASE ? if they did NOT, then legally i would think that she is still entitled to her 'reserved' car.
BUT if her dealer applied the $99 as a 'credit' towards the purchase of her 'orphan', then she no longer has a 'deposit' on an ordered car, making IT an 'orphan' and she's S.O.L.!
"heathere3"? did you get your $99 credited toward your 'orphan'purchase?

No, I most certainly did not get my $99 credited towards my orphan. Smartusa still has it. I very specifically asked the dealership what would happen to my reservation since I was not interested in taking the orphan if it negated my ordered car! :P
Ooops. Yeah, I thought you had the yellow one already (BTW, has your husband been driving it in the past few months? saw what I thought was you coming, and it was some dude w/a beard! ).
Have you physically been down to the dealer? I know which dealer you're at, and they have always treated me very well. Maybe a personal visit is in order? How much diiferent is your orphan than the one you ordered?
IIRC, there was one orphan there today. I think I heard that. I think things like this happen when human beings are involved, and demand is soooooo far exceeding supply. scary...
Hi NYSmartie!
Yes, hubby has gotten to drive it a little and did mention getting to wave at you! And he does have a beard How insane has it been for you at work this week with all the media? I'm still on summer hours until mid-August, but I expect we'll be waving at each other again then!
I have not physically gone in to the dealership since this latest saga started. And the orphan is a fair bit different from my reserved car. Enough that I'd really rather get "my" car, esp. since I have a buyer for my orphan such that worth my while to switch.
Hey Heather, how are you tracking the car? Through the VIN # I would assume. What site have you gone to? PM me and I'll see what I can scare up. I seem to have good luck with this stuff.

Hi Ducati!
Both smart and Smithtown have refused to give me the VIN, so I don't have that, and given that they've both acknowledged that "my" car has been sold to someone else, I don't think it would really do any good any more But thanks for the offer! The only 'tracking' I had been able to do was through the DDE, which as I said above changed from showing a date range to delivered, and through conversations with the dealership and smartusa. I didn't receive the '30 day warning' call which is how most people get their VIN in advance to track it. I'm still waiting to see what sort of resolution they offer me

ah, ok, understood. I sure hope they can work something out to your satisfaction.(fingers crossed)
yes, the courthouse has been nuts this morning. and as a matter of fact, I saw her (Christie Brinkley, for those not in the know) this morning coming into the building. I was not 5 feet from her. still, a very stunning woman no doubt.
heathere, good luck in getting the car you want. I have wondered about "mistakes" like these and how often they happen. This is the first of this kind that I've read on the forum. I'm sure you'll be taken care of. Too many others (on this forum alone) that will rally if you aren't.
