car in gear takes off on its own when taking foot off brake

Our 2008 passion in forward or reverse will "take off" on its own when you take your foot off the brake. This is WITHOUT my foot on the throttle!!! Really does not "sound" like it is idled up too much but that is dangerous. What gives??!! Surely that is not normal? Only had the car 2 days. 85,000 miles.

By takes off you mean it starts moving slowly or do you actually mean it starts accelerating quite seriously. Smarts do have the creep mode. When you release the brake it is normal to move.
At what rpm is your idle. If your smart didn't come with an rpm gauge you can use a scan gauge (kinda pricey) or just order a Bluetooth OBD2 dongle from eBay and download torque from the app store.

Totally normal for the car to start to creep at idle whether in forward or reverse. Same as any regular automatic transmission car. If you are in stop n go traffic pull up on emergency brake 1 notch. This will disable creep but you will get the “brake warning” beep until releasing emergency brake fully.

Try the throttle body reset:

Insert key and turn to 1 so the electrics are on but the engine is off.
Press the accelerator pedal all the way to the floor (including kickdown if you have it).
Hold the pedal down for 5 seconds and turn the key back to 0.
Now release the pedal.
Wait a minute or so before starting your car.
