On a standard remote, on the top of the key, there are 4 buttons.
1) red Panic button which sets off the horn, located at 12 o' clock position
2) door lock button looks like a closed locked at the 6 o' clock position
3) door unlock at the 3 o' clock position
4) rear hatch release at the 9 o'clock position.

the rear hatch release should open the back hatch on a cabriolet, there are 2 latches to release the top once the hatch is opened. If the remote button doesn't work, you should be able to unlock the doors and use the handle on the rear hatch to open the back end. If that doesn't work, you will need to move the seat forward, climb in the back and drill 3 holes to manually release the latches. that will get the hatches open, then they will have to be troubleshot to see why they don't work.

I would check all the fuses to see if one is blown before I went too far.

I also would recommend a subscription to the Evilution.com site which has tons of procedures and help with everything for all versions of the smart cars. All models from 45-453 (including European models)

Whoops, I somehow read 2008 but missed “convertible”. *embarrassed look*

FYI, if after you have tried this and the tailgate will still not open it is likely that it is the cover over the spot here you stash your side rails when you have the top down and rails off. Mine does this frequently as it doesn't shut properly and therefore jams when you try and drop the tailgate. Usually have to push it back in place from the inside.

Are you sure about #4 , on a Cabrio one button remotely opens the convertible top...

From page 56 in the manual:

soft top (cabriolet only)
You can fully open the retractable soft top
with the key.
Key with remote control
1) button 2 Lock button
2) button 4 Opening the retractable soft top
3) button 1 Unlock button

Opening: Press button 4 on the key for
approximately two seconds.
The retractable soft top opens.
i Pressing buttons 2.3 or 4 on the
key with remote control while opening
the retractable soft top will interrupt
the opening procedure.

Closing: Press close button on dash, the
retractable soft top switch

2) Pull the release handle in handle recess of the tailgate. (above license plate)

The tailgate is unlocked.

Swivel the tailgate downwards to open.

I can only assume you do not have an owners manual so here is a link for all the years manuals:

Reading that is a little confusing. I think it assumes the driver's door is unlocked. My Cabrio remote has four buttons.
  • Red panic button that sets off the alarm (way too often when I'm getting the key out of a pocket :()
  • Locking button
  • Roof opening button
  • Unlocking button: Press once to unlock driver's door, twice to unlock passenger door, and again to unlock rear hatch.

Reading that is a little confusing. I think it assumes the driver's door is unlocked.
The OP's comment, "There is no button inside the car" (except for the one on the button panel?) would suggest interior access?

Instructions have been shared from Owners Manual, YouTube and personal experience and 13 posts later nothing more from Peggy?

Yeah, I feel like such an idiot. I must have mis-punched my remote a bunch of times. I put my dog in the back of my smart everyday, sometimes 3-4 times. It always seemed like it took a third push to unlock the hatch.

I tried it today and yep, just like you and the manual said, 2nd push u locks the pass door and the rear hatch.

FWIW, after owning my smart for 6 years, I only realized the rear hatch was electric last year when I had to replace one of the hinges. I've always squeezed it and pulled it open like it was a mechanical latch. Now I pull the handle up and the electricity do its job!:laugh::laugh:
